1) Agreement to Terms

By accessing or using the Site/Services, you agree to be bound by these Terms and our other policies (including our Privacy Policy and Refund & Return Policy). If you do not agree, do not use the Site/Services.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site/Services or place orders.

3) Products & Personalization

Many items are made to order and may include personalized details (e.g., name meaning, poems). Minor color or placement variations may occur between on-screen mockups and final prints. Personalized items are typically not eligible for returns except for verified manufacturing defects—see our Refund & Return Policy.

4) Orders, Pricing & Availability

• We may refuse or cancel any order for any reason (suspected fraud, errors, or unavailable product).
• Prices, taxes, shipping, and promotions may change at any time.
• You authorize us (and our payment processor) to charge your payment method for the full order amount, including applicable taxes and shipping.
• If a product is discontinued, delayed, or out of stock, we may cancel and refund you, or contact you about alternatives.

5) Shipping, Delivery & Risk of Loss

• Orders are produced and shipped by our trusted print partners (e.g., through Printify’s network).
• Delivery estimates are not guarantees; carrier or customs delays are outside our control.
• Risk of loss passes to you upon delivery to the address you provide.

6) Quality Issues, Returns & Refunds

Please review our Refund & Return Policy for the full process and timelines. Defect/quality claims (e.g., misprint, damage) must be reported within 30 days of delivery with photos. Approved claims may receive a no-cost replacement or refund.

7) Account Registration & Security

• Provide accurate, current information and keep it updated.
• You are responsible for safeguarding your login and all activities under your account.

8) Acceptable Use

You agree not to: use the Site/Services for unlawful purposes; infringe third-party rights or submit content you do not have permission to use; interfere with security features or attempt unauthorized access; upload malware; or engage in scraping/data mining without our consent.

9) Intellectual Property

All content on the Site (text, graphics, logos, designs, compilations) is owned by or licensed to Daring Faith Brands and protected by law. You may not reproduce, distribute, or create derivative works without our written permission.

User Content (e.g., reviews): By submitting content, you grant us a worldwide, royalty-free license to use, display, reproduce, and distribute it in connection with the Site/Services and marketing (you retain ownership of your content).

10) Third-Party Services

We may use third-party providers (e.g., Shopify, Printify, payment processors, carriers). We are not responsible for the acts/omissions of such providers. Your use of their services may be subject to their terms.

11) Payments & Taxes

We accept payments through Shopify Payments or other processors we enable. You authorize all applicable charges. You are responsible for any taxes not collected at checkout if required by law.

12) Disclaimer of Warranties

The Site/Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

13) Limitation of Liability

To the fullest extent permitted by law, Daring Faith Brands, its owners, members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages; and our total liability for any claim shall not exceed the amount you paid for the product(s) giving rise to the claim.

14) Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, costs, and expenses arising from your use of the Site/Services, your violation of these Terms, or your infringement of any rights.

15) DMCA / IP Complaints

If you believe your copyrighted work has been used on the Site in a way that constitutes infringement, email info@daringfaithbrands.com with: (a) your contact info; (b) description and URL of the material; (c) a statement of good-faith belief and accuracy under penalty of perjury; and (d) your physical or electronic signature. We may remove content and/or terminate repeat infringers.

16) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Ohio. Except for small-claims or injunctive relief for IP misuse, any dispute shall be resolved by binding arbitration on an individual basis in Franklin County, Ohio, under the rules of the American Arbitration Association. No class actions or jury trials. For matters not subject to arbitration, the state and federal courts in Franklin County, Ohio have exclusive jurisdiction.

17) Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (including natural disasters, labor disputes, supply shortages, war, government actions, or internet outages).

18) Changes to the Terms

We may update these Terms at any time by posting a revised version with a new Effective Date. Your continued use after changes means you accept the updated Terms.
